These Terms & Conditions govern the subscription and use of services provided by RACAP Foundation (“Racap”, “we”, “us”) through its website www.racfo.org and its sub-domains. By subscribing to or using the Services, the User agrees to be bound by these Terms.

- Services: All services subscribed to by the User and provided by Racap under this Agreement.
- Subscription Fee: The fee payable by the User to Racap for availing the Services, as prescribed by Racap.
2. Terms of Use
The User agrees to:
- Provide complete and accurate information during registration.
- Use the Services in compliance with applicable laws and these Terms.
- Prevent unauthorized access to the Services and promptly notify Racap of any breach.
- Maintain confidentiality of login credentials.
The User shall not:
- License, sell, share, transfer, or make the Services available to third parties.
- Copy, modify, or create derivative works of the Services.
- Frame, mirror, or misuse any part of the Website or Services.
- Use the Services beyond the permitted scope.
3. Dashboard Access, Monitoring & Suspension Rights
Racap reserves the right to monitor, regulate, and control access to the User’s dashboard, account, and login credentials to ensure compliance with these Terms.
In the event of:
- Any violation of these Terms.
- Misuse or unauthorized use of the dashboard or Services.
- Unauthorized access, data compromise, or suspicious activity.
- Receipt of any information or reasonable suspicion of misuse or unlawful activity.
Racap shall not be liable for any loss, damage, interruption, or consequences suffered by the User due to such suspension, restriction, or discontinuation of dashboard access.
4. Intellectual Property Rights
All intellectual property rights in the Services, including copyrights, trademarks, and proprietary content, belong exclusively to Racap. No rights are granted to the User except as expressly stated in this Agreement.
5. Confidentiality & Data Usage
Both parties shall maintain confidentiality of all confidential information exchanged under this Agreement and use reasonable care to protect such information.
Racap shall access User Data only as required to:
- Provide and support the Services.
- Resolve technical or service-related issues.
- Comply with legal obligations.
Racap may use User Data to improve services, conduct market research, and personalize offerings. By subscribing, the User consents to receive service-related and promotional communications, which may be unsubscribed from at any time.
6. Payment Terms
The User shall pay the applicable Subscription Fee as per the invoice or payment schedule issued by Racap.
7. Term
This Agreement shall remain effective for the duration agreed upon between Racap and the User, unless terminated earlier as per these Terms.
8. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India. Courts located in Delhi shall have exclusive jurisdiction over any disputes arising from this Agreement.
9. Miscellaneous
- Racap may modify, suspend, or discontinue the Services due to regulatory or legal changes.
- Racap shall not be liable for losses caused due to events beyond its reasonable control.
- Racap may suspend or terminate User access in case of breach, misuse, or unlawful activity.
- Upon termination, the User shall lose access to stored data on the Website.
- Racap shall not be liable for any indirect or consequential damages.
- Racap may update or improve the Services, and such updates shall form part of this Agreement.
- Racap reserves the right to amend these Terms at any time without prior notice.
- Publicly available information may be freely used without User consent.
- The Website uses cookies to enhance user experience; disabling cookies may limit functionality.
- User Data must not contain unlawful, offensive, or infringing material.
